Sanctions require notice, a hearing and court discretion
Texas Rule of Civil Procedure 21b addresses a party’s failure to serve or deliver a copy of a pleading, plea, motion or other application for an order as required by Rules 21 and 21a. After notice and a hearing, the court may impose an appropriate sanction available under Rule 215-2b.
Start with the service requirement that was not met
The rule connects the possible sanction to the underlying service obligation. Read Rule 21 for filing and service duties and Rule 21a for service methods and proof. A service dispute does not make a particular sanction automatic: Rule 21b expressly leaves the decision to the court’s discretion.
Keep the cross-reference with the rule
The illustration presents Rule 21b’s complete text. Its reference to Rule 215-2b matters because that provision identifies the available sanctions; Rule 21b does not supply a separate list.
