TRCP / Rule 1

Objective of rules

Understand the goals of fair adjudication, prompt resolution and practicable economy.

Fair adjudication is the objective

Texas Rule of Civil Procedure 1 directs the rules toward a just, fair, equitable and impartial adjudication of litigants’ rights under established substantive law. It also calls for resolving cases as promptly and economically as practicable for both the parties and the state.

Read procedural requirements in light of that purpose

Rule 1 requires liberal construction of the procedural rules to achieve those objectives. It gives readers a starting point for understanding the rulebook; the particular rule governing a filing, service requirement or motion supplies the requirements for that step.

Start with the step you need to understand

For example, if you are learning how a motion reaches the court and the other parties, read Rule 21 alongside this general objective. The illustration below presents the complete text of Rule 1.
